Texas Children’s Health Plan Wins Temporary Injunction

Medicaid / CHIP Provision of Care Remains in Place for Patients and Members

HOUSTON, October 7, 2024 – On June 20, 2024, Texas Children’s Health Plan (TCHP), along with several other Texas plans, filed a lawsuit against the Texas Health and Human Services Commission (HHSC) and its Executive Commissioner in Travis County, TX, to prevent HHSC from signing contracts that were improperly awarded as a result of a legally flawed Medicaid (STAR/CHIP) procurement. 

On Friday, in a major victory for TCHP and the other plans, the judge overseeing the suit granted a temporary injunction that prevents HHSC from signing and executing these contracts. 

“We are grateful to the Court for agreeing with our position,” said Michael Murphy, President of TCHP. “It is unfortunate that it had to come to this point. HHSC’s flawed process would disrupt and jeopardize the care of 425,000 of the state’s most vulnerable children and pregnant women, who rely on TCHP for their health coverage.” 

All TCHP members and their families can be assured that with this ruling, there will be no disruptions in coverage, while we continue advocating for the privilege to remain the health plan provider for our Medicaid and CHIP members. 

“While litigation is never preferable, HHSC left us no choice,” Murphy said. “We will continue to leave no stone unturned in protecting and advocating for our members and the families we serve.”

This ruling in TCHP’s favor now allows the Texas Legislature the opportunity to intervene and address the serious concerns and issues with the current HHSC procurement process, for the sake of this vulnerable population and the state’s future.
